Wix SPAM Protection intends to protect you from receiving spam and malicious phishing attempts on your email address and voice phone number, as this information is publicly available through the domain name`s whois directory, as required by ICANN. You agree that such registration by registering the domain name you have chosen does not grant immunity to objections to the registration or use of your domain name. Wix`s (and the registrar`s) ability to provide services to you depends in part on the provision of services by third parties, such as. B the relevant domain name registry that provides country-specific top-level domains (“ccTLDs”) or generic top-level domains (“gTLDs”).
Wix cannot control and is not responsible for the acts or omissions of such third parties. You acknowledge and agree that Wix will not be liable to you or any other party for any claim, damage, loss, expense or cost incurred or incurred by you as a result of the actions of any third party, including, but not limited to, the registry applicable to your ccTLD or gTLD. Wix makes no warranty that your proposed domain name application, even if offered by Wix, will be accepted by the relevant registrar or that it will not infringe any third party rights. You acknowledge and agree that the proposed application for registration for one or more domain names submitted by Wix and/or the registrar may fail or be rejected by the relevant registry for a number of reasons, including, but not limited to, the fact that your proposed domain name application was not the first at the time. You acknowledge and agree that the success of registration depends on a number of different factors that Wix cannot predict or control. You hereby assume all responsibility for the domain name you choose, even if offered by Wix, and acknowledge that if the domain name infringes the rights of third parties or is otherwise prohibited, it may be subject to arbitrary or other proceedings, even after registration. Wix reserves the right, in its sole discretion, to refuse registration of a selected domain name or to delete the domain name you have chosen within the first thirty (30) calendar days of receiving your payment for that domain name. In the event that we do not register the domain name you have chosen or delete the domain name you have chosen within thirty (30) calendar days, we undertake to reimburse all fees paid by you. You agree that we will not be liable to you for any loss or damage that may result from our refusal to register the domain name you have chosen, the deletion of the domain name you have chosen, or the refusal to register for other Wix Services.
The Dispute Resolution Policy governs all disputes with third parties regarding your use of the domain name. You agree to indemnify and hold us harmless from any domain name dispute with any third party in accordance with the terms set forth below in this Agreement. If we are informed that a complaint has been filed with a judicial or administrative authority regarding your use of our domain name registration services, you agree not to make any changes to your domain name registration without our prior consent. We may not allow you to make changes to this list of domain names until (c) an unauthorized change to the domain name account is resolved. The registrant retains full control over the domain name and its registration records and may disable and enable the Wix SPAM Protection service at any time through your account. If they are not disconnected, disabling Wix SPAM protection is subject to a 60-day transfer ban between registrars. If you have registered a domain name through Wix, you agree to be bound by ICANN`s current Domain Name Dispute Policy (the “Dispute Resolution Policy”) contained herein and incorporated by reference into this Agreement. The current version of ICANN`s Domain Name Litigation Policy can be found at www.icann.org/dndr/udrp/policy.htm. In the event of any conflict between the provisions of this Agreement and those of the Dispute Resolution Policy, the provisions of this Agreement shall prevail. You are aware that the Dispute Resolution Policy may be amended from time to time.
You agree that by maintaining the reservation or registration of your domain name after the changes to the Dispute Resolution Policy come into effect, you have accepted those changes. You acknowledge that if you do not agree to such a change, you may terminate this Agreement. Subject to the requirements of Wix`s Privacy Policy, you hereby grant Wix and the Registrar the right to access a publicly available interactive registration database (e.B. WHOIS) that you must provide when registering or reserving a domain name to third parties through a publicly accessible interactive registration database (e.B.
